These Terms and Conditions (“Terms”) govern participation in Reflections Holidays Outsiders Loyalty Club (“the Program”), operated by Reflections Holidays ABN (ABN 26 087 692 248) (“Reflections Holidays”, “we”, “us”, “our”). By enrolling in the Program or by earning or redeeming Benefits, you (“the Member”, “you”, “your”) agree to be bound by these Terms.
If you do not accept these Terms, you should not join or continue to participate in the Program.
- Definitions and Interpretation
- In this Agreement, unless the context otherwise requires, the following terms shall have the meanings assigned to them.
- The “ACL” refers to the Australian Consumer Law, being Schedule 2 to the Competition and Consumer Act 2010 (Cth), as amended from time to time.
- “Benefits” means all rewards, discounts, privileges, upgrades, vouchers, promotional offers or other advantages made available to Members by virtue of participation in the Program.
- “Calendar Year” means the period commencing on 1 January and ending on 31 December in each year.
- “Eligible Accommodation” means accommodation owned and operated by Reflections Holidays that is generally available to a guest or tourist on a short-term basis, including cabins, villas, tiny homes, beach tents, and powered or unpowered camp sites at a Reflections Holidays Place, and which qualifies for the earning and redemption of Loyalty Guest Credit as determined and notified by Reflections Holidays from time to time.
- Eligible Accommodation expressly excludes:
- accommodation, residency or occupation of a site in accordance with, or otherwise subject to, the Holiday Park (Long-term Casual Occupation) Act 2002 or the Residential (Land Lease) Communities Act 2013;
- goods and services not properly characterised as accommodation for tourists, including boatshed hire, shelter hire, kiosk purchases, event and equipment hire, reserve hire, day visitation passes, annual visitation passes, site holder fees and ancillary charges, and fees and charges for corporate, group and park residences; and
- stays booked through Online Travel Agents or third-party websites, stays on employee or staff rates, promotional or complimentary stays, and any other excluded accommodation types notified by Reflections Holidays from time to time.
- “Force Majeure Event” means any act, circumstance or event beyond the reasonable control of Reflections Holidays including, without limitation, acts of God, natural disasters, pandemics, epidemics, strikes, industrial disputes, labour shortages, fire, flood, storm, system outages, telecommunications or internet failures, cyber incidents or attacks, terrorism, war, civil unrest, embargoes, government restrictions or regulations, or any other similar cause beyond Reflections Holidays’ reasonable control.
- “Group Booking” means a booking made for multiple Guests or reservations under one primary organiser.
- Guest” means a natural person who makes or undertakes a booking at a Reflections Holidays Place, whether or not they are a Member.
- “Loyalty Guest Credit” means the credit described in Clause 3, which may be earned and redeemed by Members in accordance with these Terms.
- “Loyalty Number” means the unique identifier assigned to each Member upon successful registration for the Program.
- “Manager, Reflections Loyalty Club” means the person appointed by Reflections Holidays from time to time to oversee the Program and Membership administration.
- “Member” means an individual enrolled in the Program in accordance with Clause 2.
- “Membership” means participation in the Program by a Member.
- “Membership Account” means the account maintained by Reflections Holidays to record each Member’s participation, including the accrual and redemption of any form of Benefits.
- “Membership Portal” means the online portal located at www.reflectionsholidays.com.au/rewards (or such replacement site as Reflections Holidays may nominate) through which Members may manage their Membership.
- “Nights Count” means the cumulative number of nights stayed by a Member in Eligible Accommodation in a single calendar year, as referenced in Clause 3.3.
- “Privacy Policy” – the privacy policy published by Reflections Holidays and updated from time to time.
- “Program” means Reflections Holidays Outsiders Loyalty Club loyalty program operated by Reflections Holidays (ABN 26 087 692 248), including any associated websites, Membership portals, mobile applications, communications and promotional activities, as amended, renamed, rebranded, replaced, suspended or resumed from time to time in accordance with these Terms.
- “Raincheck” means the loyalty feature available exclusively to Explorer and Trailblazer Members, which allows a Member to cancel a booking during non-cancellation periods (including mid-stay) and receive Raincheck Credit for the unused portion of their booking, in accordance with Clause 5.5.
- "Raincheck Credit” means the credit issued to Explorer or Trailblazer Members in accordance with Clause 5.5, upon cancellation of a booking under the Raincheck benefit.
- “Reflections Holidays” – Reflections Holiday Parks, a trading name of Reflections Holiday Parks Crown Lands Trust (ABN 26 087 692 248).
- “Reflections Holidays Place” means any holiday park, accommodation site, or property owned or operated by Reflections Holidays that is designated by Reflections Holidays as eligible for participation in the Program.
- “Serious Misconduct” means conduct by a Member that materially harms, or has the potential to materially harm, Reflections Holidays, the Program, or other Members, including but not limited to:
- fraud, dishonesty, or misrepresentation in connection with the Program;
- the resale, transfer, or unauthorised dealing of Benefits, or Membership;
- abusive, threatening, or offensive conduct towards Reflections Holidays staff, contractors, or other Members or Guests;
- wilful misuse or abuse of the Program or its systems; or
- any other conduct which Reflections Holidays reasonably determines to be fraudulent, unlawful, or seriously detrimental to the reputation or operation of the Program.
- “Stay Count” means the cumulative number of stays completed by a Member at different Reflections Holidays Places in a single calendar year, as referenced in Clause 3.4.
- “Ticket to Tour Credit” means the once-per-year credit described in Clause 3.5, awarded upon meeting the required thresholds of nights and stays in a single calendar year.
- “Tier Status” or “Tier” means the Membership level within the Program (Member, Explorer, Trailblazer, or such other tiers as Reflections Holidays may establish), as determined in accordance with Clause 5.
- Unless the context otherwise requires, words importing the singular include the plural and vice versa, and references to legislation include any amendments, re-enactments or replacements thereof. Headings are for convenience only and do not affect interpretation.
- Membership
- Membership of Reflections Holidays Outsiders Loyalty Club is free ($0), both to join and on an ongoing basis. There are no joining or annual fees.
- Membership in the Program is open only to natural persons who are eighteen (18) years of age or older at the time of enrolment. Corporations, partnerships, associations or any form of artificial legal entity are not eligible to participate unless expressly approved by Reflections Holidays in writing. Membership is provided on a complimentary basis, although certain tiers or levels of Membership may require a minimum qualifying spend or activity to achieve or maintain status.
- Any person wishing to become a Member must apply for Membership in the manner prescribed by Reflections Holidays. Reflections Holidays may accept or decline any application for Membership, provided that any decision will not be exercised unreasonably, arbitrarily, or in contravention of applicable law.
- Submission of accurate and complete personal details is mandatory for the activation and verification of Membership. Such details may include, without limitation, the applicant’s full name, email address, contact phone number, postcode and date of birth. A valid email address is mandatory to create and maintain Membership. Members who do not provide a valid email address at sign-up, or whose email address is found to be invalid, may have their Membership cancelled unless a valid email address is subsequently provided. Members acknowledge that communications relating to their Membership, including notification of Benefits, balances, and changes to the Program, will be sent by email. Members who unsubscribe from Membership emails will continue to hold their Membership but may no longer receive communications about their Benefits, offers, or activity.
- All personal information collected will be handled in accordance with Reflections Holidays Privacy Policy, which forms part of this Agreement and is available on Reflections Holidays website.
- Each individual is permitted to hold only one Membership Account. In the event that duplicate accounts are created, Reflections Holidays reserves the right to consolidate those accounts or to cancel one or more of them in its discretion.
- Upon successful enrolment, each Member will be assigned a unique Loyalty Number linked to their Membership Account. This Loyalty Number is personal to the Member and must be quoted when making bookings or transactions in order to earn or redeem Benefits.
- Employees of Reflections Holidays are eligible to join the Program; however, specific conditions apply where employee discounts or staff rates are used. Benefits may not be earned or redeemed in conjunction with employee discounts, staff rates, or other promotional offers unless expressly permitted by Reflections Holidays.
- Membership will be current and valid from the date of successful registration and will remain so for as long as Reflections Holidays continues to operate and maintain the Program in its current format, unless earlier terminated in accordance with these Terms.
- Reflections Holidays may establish and maintain different Membership tiers under the Program, including but not limited to the Member, Explorer and Trailblazer tiers described in these Terms. Each tier will be subject to specified eligibility criteria, which may include factors such as annual spend, number of nights stayed, or other Program activity, and will carry corresponding Benefits.
- Reflections Holidays may vary the criteria or Benefits applicable to each tier from time to time, provided that any variation will not materially reduce Benefits already earned, and that reasonable notice of the change is given to Members in accordance with this Agreement.
- Loyalty Guest Credit
- General
- Members may also earn and redeem Loyalty Guest Credit through specific incentives offered by Reflections Holidays. Loyalty Guest Credit has no cash value, cannot be exchanged for money, and is only redeemable in accordance with these Terms.
- On becoming a Member, you will be eligible to earn Loyalty Guest Credit in three forms, depending on your activity:
- Nights Credit (clause 3.3) – credits awarded for accumulating qualifying nights stayed;
- Stay Credit (clause 3.4) – credits awarded for stays at different Reflections Holidays Places; and
- Ticket to Tour Credit (clause 3.5) – a once-per-year credit equal to total Eligible Accommodation spend if qualifying thresholds are achieved.
- Members may also achieve tier status and associated Benefits on meeting the criteria set out in these Terms.
- Discontinued Sign-up Credit
- Effective from 1 July 2025, Members are no longer eligible to receive a $25 Sign-up Loyalty Guest Credit on joining Reflections Holidays. This Loyalty Guest Credit was previously issued once on enrolment for new Members but ceased to be offered after 30 June 2025. Any Sign-up Loyalty Guest Credits issued prior to this date remain subject to their original validity period and redemption rules.
- Nights Credit
- We want to you to earn while you stay with us.
- Members will be entitled to receive a Nights Credit, being a $25 Loyalty Guest Credit earned by accumulating nights stayed in Eligible Accommodation. Accumulated nights will be referred to as a Member’s Nights Count. A Nights Credit will be applied each time a Member’s Nights Count reaches 7, 14, 21, 28, 35, 42, 49, 56, 63 or 70 nights in a calendar year. The maximum Nights Credit that may be earned in a calendar year is capped at $250.
- At midnight on 31 December each year, a Member’s Nights Count will be reset to zero.
- Nights are counted cumulatively towards a Member’s Nights Count across all reservations for Eligible Accommodation.
- A Member’s group booking will only contribute to the Nights Count at the individual reservation level, as if it were a single reservation, and will not multiply concurrent nights by the number of reservations in the group.
- Nights Credit will be applied to a Member’s account after departure from the stay in which the qualifying threshold is reached.
- Nights Credit will remain valid for 12 months from the date of issue and must be redeemed within that period.
- Nights Credit cannot be redeemed or applied towards a future Eligible Accommodation booking in the form of a deposit payment.
- Nights Credit cannot be used to refund money already paid, but may be applied to an existing booking if the balance has not yet been fully paid.
- Stay Credit
- We want to reward you for exploring different Reflections Holidays Place throughout the year! Here's how you can earn $25 Stay Credits:
- Each time you stay at a different Reflections Holidays Placein the same calendar year, you'll earn credits (after your first stay).
- Your first park visit of the year sets you up - but doesn't earn a credit.
- From your second different park onwards, you'll receive a $25 credit each time.
- You only earn credits for visiting new parks - returning to the same park won't earn extra credits.
- For example:
- Stay at Park A = Sets up your membership (no credit).
- Then stay at Park B = Get $25 credit.
- Then stay at Park C = Get another $25 credit.
- Return to Park A = No additional credit (already visited).
- As detailed above, Members will be entitled to receive a Stay Credit, being a $25 Loyalty Guest Credit earned by accumulating stays at different Reflections Holidays Places (each such place being part of Eligible Accommodation). The count of accumulated stays will be called a Member’s Stay Count. Stay Credit will be earned at every new Reflections Holidays Place a Member stays at in a calendar year (after departure). The first Reflections Holidays Place stayed at in a calendar year is excluded; Stay Credit is first applied after staying at a second Reflections Holidays Place in that year, then at the third, fourth, fifth, and so on. A $25 Loyalty Guest Credit will be applied at each new threshold. Stay Credit is capped when a Member has stayed at every Reflections Holidays Place in a single calendar year. If a Member stays at a place they have already visited in the same calendar year, no additional Stay Credit will be applied.
- At midnight on 31 December each year, a Member’s Stay Count will be reset to zero. In the new calendar year, the first Reflections Holidays Place stayed at will again be excluded from a $25 Loyalty Guest Credit, and credits will then be assigned as outlined above.
- A stay must be a minimum of 2 nights to count towards a Member’s Stay Count.
- Stay Credit will be applied to a Member’s account after departure from the stay in which it was earned and cannot be used on the stay in which it is earned.
- Stay Credit will remain valid for 12 months from the date of issue and must be redeemed within that period.
- Stay Credit cannot be redeemed or applied towards a future Eligible Accommodation booking in the form of a deposit payment.
- Stay Credit cannot be used to refund money already paid, but may be applied to an existing booking if the balance has not yet been fully paid.
- Ticket to Tour Credit
- Members will be entitled to receive a Ticket to Tour on staying at least 20 Reflections Holidays Places (each such place being part of Eligible Accommodation) over at least 100 nights (Nights Count over 100) in a single calendar year. A Ticket to Tour is a Loyalty Guest Credit that will be assigned to the Member’s account in the calendar year following the calendar year in which it is earned. The Loyalty Guest Credit will be equal to the total spend by the Member on Eligible Accommodation bookings in the calendar year in which it is earned.
- For example, if a Member stays for 105 nights across 22 Reflections Holidays Places in 2024 and spends $5,000 in the process, Reflections Holidays will issue a Ticket to Tour in the form of a $5,000 Loyalty Guest Credit to be used in 2025.
- All qualifying nights and stays must occur within a single calendar year to count towards a Ticket to Tour incentive.
- Members using Ticket to Tour Credit will not be able to earn Nights Credit or Stay Credit, and their Nights Count and Stay Count will not increase while redeeming Ticket to Tour Credit.
- A Member’s group booking will only contribute to the Nights Count at the individual reservation level, as if it were a single reservation, and will not multiply concurrent nights by the number of reservations in the group.
- A stay must be a minimum of 2 nights to count towards a Member’s Stay Count.
- A Member’s Nights Count and Stay Count will reset to zero on 1 January each year.
- Ticket to Tour Credit will remain valid for 12 months from the date of issue and must be redeemed within that period.
- Ticket to Tour Credit may be redeemed or applied towards a future Eligible Accommodation booking in the form of a deposit payment.
- Ticket to Tour Credit cannot be used to refund money already paid, but may be applied to an existing booking if the balance has not yet been fully paid.
- Ticket to Tour Credit is calculated solely by reference to spend on Eligible Accommodation bookings and excludes kiosk purchases, laundry, equipment hire, and any bookings paid for using Loyalty Guest Credit.
- Ticket to Tour spend and credit calculations will only consider a single Member’s account and will not aggregate multiple accounts.
- Benefits and Restrictions
- Membership in the Program entitles you to receive Benefits as determined by Reflections Holidays from time to time. Benefits may include, without limitation, discounts on accommodation or services, complimentary upgrades, early check-in or late check-out privileges, exclusive offers, vouchers, or invitations to special events. Reflections Holidays reserves the right to vary the nature, availability and scope of Benefits at its discretion.
- Benefits are provided solely as a promotional incentive and do not constitute property or vested rights. All Benefits are personal to you as the Member and may not be transferred, assigned, gifted, exchanged, bartered, sold, or redeemed for cash or credit, unless Reflections Holidays expressly permits otherwise. Any attempt to sell, assign or otherwise deal with Benefits contrary to this clause will render them void and may result in termination of your Membership. Membership itself is also non-transferable, as set out in Clause 5.
- All Benefits are subject to availability and may be subject to restrictions such as blackout periods, peak holiday periods, public holidays, limited capacity, or other usage limitations. Blackout dates will be published annually on the Program website, and Reflections Holidays reserves the right to impose additional restrictions as necessary to manage capacity. Reflections Holidays makes no guarantee that any particular Benefit will be available at any time and reserves the right to substitute Benefits of equal or greater value.
- Benefits may not be earned, combined, or redeemed in conjunction with employee discounts, staff rates, or other promotional offers unless expressly permitted by Reflections Holidays.
- Membership Tiers
- General
- Members will be eligible to receive a Tier Status on meeting the specified criteria. Tier statuses will first be assigned on 1 September 2025 and thereafter periodically as Members reach the relevant tier levels. Tier status is determined and assigned at the discretion of Reflections Holidays.
- Tier statuses are:
- Member
- Explorer
- Trailblazer
- To reach the base level Member tier, a Guest must meet the conditions outlined in Clause 2 (Membership).
- Explorer Tier
- To be eligible for Explorer tier status, a Member must, within a single calendar year:
- Stay at least two different Reflections Holidays Places where the stay has been completed (Stay Count 2+).
- Each stay must be a minimum of two (2) nights.
- Stays must be booked directly with Reflections Holidays and exclude all Online Travel Agent bookings.
- Stays cannot be earned alongside employee discounts.
- Stays cannot be earned on non-Eligible Accommodation types.
- Spend at least AUD 1,000 with Reflections Holidays in Eligible Accommodation within that year.
- Spend must be on Eligible Accommodation tourist bookings and excludes kiosk purchases, laundry, equipment hire, and any Loyalty Guest Credit used.
- Spend will only consider a single Member’s account and will not aggregate multiple accounts.
- At midnight on 31 December each year, a Member’s spend will be reset to zero for the purpose of calculating status levels.
- Stay at least 10 nights in Eligible Accommodation (Nights Count 10+).
- At midnight on 31 December each year, a Member’s Nights Count will be reset to zero.
- Nights are counted cumulatively across all reservations for Eligible Accommodation.
- Group bookings will only contribute to the Nights Count at the individual reservation level, not multiplied across the number of reservations in the group.
- Nights Count can only increase on direct bookings and excludes Online Travel Agent bookings.
- Nights Count cannot increase through employee discounts.
- Nights Count cannot increase through non-Eligible Accommodation types.
- Trailblazer Tier
- To be eligible for Trailblazer tier status, a Member must, within a single calendar year:
- Stay at least three different Reflections Holidays Places where the stay has been completed (Stay Count 3+).
- Each stay must be a minimum of two (2) nights.
- Stays must be booked directly with Reflections Holidays and exclude all Online Travel Agent bookings.
- Stays cannot be earned alongside employee discounts.
- Stays cannot be earned on non-Eligible Accommodation types.
- Spend at least AUD 2,500 with Reflections Holidays in Eligible Accommodation within that year.
- Spend must be on Eligible Accommodation tourist bookings and excludes kiosk purchases, laundry, equipment hire, and any Loyalty Guest Credit used.
- Spend will only consider a single Member’s account and will not aggregate multiple accounts.
- At midnight on 31 December each year, a Member’s spend will be reset to zero for the purpose of calculating status levels.
- Stay at least 20 nights in Eligible Accommodation (Nights Count 20+).
- At midnight on 31 December each year, a Member’s Nights Count will be reset to zero.
- Nights are counted cumulatively across all reservations for Eligible Accommodation.
- Group bookings will only contribute to the Nights Count at the individual reservation level, not multiplied across the number of reservations in the group.
- Nights Count can only increase on direct bookings and excludes Online Travel Agent bookings.
- Nights Count cannot increase through employee discounts.
- Nights Count cannot increase through non-Eligible Accommodation types.
- Duration of Tier Status
- Members who achieve Explorer or Trailblazer status will hold that status for the remainder of the calendar year in which they earned it (Year 1), plus the entirety of the following calendar year (Year 2). At the end of Year 2, Members will revert to the status level that they achieved during Year 2.
- For example, if a Guest earns Trailblazer status in Year 1, they will hold Trailblazer status in both Year 1 and Year 2. If they do not again meet the criteria for Trailblazer in Year 2, they will revert to Explorer or Member status at the start of Year 3, depending on the criteria met in Year 2. If they do meet the criteria for Trailblazer in Year 2, they will continue to hold that status in Year 3.
- In practice, this means a Member will always enjoy at least one full calendar year at the status they achieve.
- Members who are demoted a tier will have the new tier status take effect on 1 January of the relevant year, in line with the criteria achieved in the prior year.
- Additional Tier Benefits
- Explorer Benefits
- Members who achieve Explorer status will receive all benefits outlined in Clauses 3.2, 3.3, and 3.4 (Nights Credit, Stay Credit and Ticket to Tour Credit), together with the following additional benefits:
- Explorer Merchandise Kit.
Members will receive an Explorer merchandise kit. The contents of this kit may be varied by Reflections Holidays at any time. To receive this kit, Members must show their Explorer welcome email to any Reflections Holidays reception. Members will only receive one Explorer merchandise kit, regardless of whether they move in and out of Explorer status across different years. The kit will be sent when Explorer status is first achieved. - First to Stay Offers.
Explorer Members will be offered access to new product stock before it is promoted to Members at other tier levels. - A single use per calendar year of the Raincheck Benefit. See Raincheck Benefits below.
- Trailblazer Benefits
- Guests who achieve Trailblazer status will receive all benefits outlined in Clauses 3.2, 3.3, 3.4, and 5.5, together with the following additional benefits:
- Trailblazer Merchandise Kit. Members will receive a Trailblazer merchandise kit. The contents of this kit may be varied by Reflections Holidays at any time. To receive this kit, Members must complete the form provided to them via email, including supplying a valid Australian postal address. Failure to complete the form or provide a valid postal address will be deemed a forfeit of this benefit. Members will only receive one Trailblazer merchandise kit, regardless of whether they move in and out of Tailblazer status across different years. The kit will be sent when Trailblazer status is first achieved. Reflections Holidays will not cover the cost of lost packages where Reflections is not at fault. Packages requested to be sent to an international address will not be dispatched unless the postage cost is covered by the Members.
- Dedicated Contact Number. Trailblazer Members will have access to a dedicated contact number to reach Reflections Holidays via a special phone line. This service and number may be changed or withdrawn at Reflections’ discretion.
- Priority Product Upgrades. Trailblazer Members may, at Reflections’ full discretion, be offered complimentary upgrades to a higher-grade product within the same category (for example, a standard site upgraded to a premium site, or a standard cabin upgraded to a premium cabin). Upgrades will not be across categories (for example, a powered site will not be upgraded to a cabin). A Members acceptance of an upgrade offer constitutes acceptance of the replacement product in place of the original booking. Reflections may rescind an upgrade offer at any time prior to check-in.
- Early Check-In. Trailblazer Members may, at Reflections’ discretion, be offered early check-in at no charge on Eligible Accommodation reservations. Reflections does not guarantee this benefit and may rescind any offer up to the point of check-in.
- Late Check-Out. Trailblazer Members may, at Reflections’ discretion, be offered late check-out at no charge. A check-out later than two hours after the standard time may be treated as an additional night’s stay, with applicable charges communicated to the Member in advance.
- Three (3) uses per calendar year of the Raincheck Benefit. See Raincheck Benefits below.
- Raincheck Benefits
- Availability. Starting 1 January 2026, Raincheck benefits will be available exclusively to Explorer and Trailblazer Members. Explorer Members may utilise the Raincheck feature once per calendar year, and Trailblazer Members may utilise the Raincheck feature up to three times per calendar year. These limits reset on 1 January each year.
- Effect. Raincheck enables Guests to cancel a reservation during non-cancellation periods (including mid-stay) and receive credit for the unused portion of their booking. Using Raincheck forfeits the right to rebook the same site or period for the following year.
- Raincheck Credit.
- Raincheck Credit will be issued equal to the value of any paid, unused portion of a stay.
- Raincheck Credit will remain valid for a minimum of three (3) months from the date of issue and must be applied to a booking with an arrival date within that period.
- Raincheck Credit is applied to a Member’s account after departure from the stay in which it was earned and cannot be used on that stay.
- Raincheck Credit may only be earned and redeemed on direct bookings for Eligible Accommodation. It cannot be earned or redeemed with Online Travel Agent bookings, employee discounts, non-Eligible Accommodation, or Long-Term Casual/Permanent accommodation.
- Raincheck Credit cannot be refunded in cash and cannot exceed the amount already paid by the Member.
- Limitations. Reflections may decline to honour Raincheck if it suspects bookings were made with the sole purpose of “holding” accommodation. Reflections reserves discretion in this determination.
- Illustrative Scenarios. By way of example only, the following scenarios illustrate how Raincheck may operate in practice:
- Scenario 1 (Cancellation Before Arrival):
Glen books a week stay at Reflections Byron Bay. The total cost of the stay is AUD 1,000 and he pays a deposit of AUD 100 with the balance payable on arrival. One day before his scheduled arrival, Glen requests to use the Raincheck feature. Assuming Glen is eligible, the booking is cancelled and he receives AUD 100 Raincheck Credit on his Guest account with a three-month expiry. Nothing further is payable. - Scenario 2 (Cancellation Mid-Stay):
Mary books a seven-night stay at Reflections Hawks Nest at AUD 700 in total. She pays AUD 70 deposit and the balance of AUD 630 on arrival. After staying four nights, Mary requests to use the Raincheck feature. Assuming Mary is eligible, the remaining unused three nights (AUD 300 value) are credited to her account as Raincheck Credit with a three-month expiry, and the booking is cancelled. - Scenario 3 (Cancellation Well Before Arrival):
Harry books a seven-night stay at Reflections Bermagui for AUD 700, paying AUD 70 deposit and the AUD 630 balance thirty-five days prior to arrival. Twenty days before arrival, Harry requests to use the Raincheck feature. Assuming Harry is eligible, the booking is cancelled, and Harry receives AUD 700 Raincheck Credit with a three-month expiry.
- Member Obligations
- It is the responsibility of each Member to ensure that Reflections Holidays is kept informed of any changes to their personal details, including residential address, email address and telephone number. Reflections Holidays will not be liable for any loss, delay, or failure in communication arising from a Member’s failure to keep their details up to date.
- Members may update their personal details by contacting Reflections Holidays by email at loyalty@reflectionsholidays.com.au, via Reflections Holidays Outsiders Loyalty Club Membership Portal available through Reflections Holidays website, or directly by telephone or in person at a Reflections Holidays Place. Contact details for individual parks can be accessed on Reflections Holidays website. Members may also be required to provide verification of identity when updating personal details.
- Updates to personal details will be managed in accordance with Reflections Holidays Privacy Policy, which can be accessed on Reflections Holidays website. It is each Member’s responsibility to regularly review the Privacy Policy and these Terms and Conditions to ensure that they are aware of any changes or updates that may affect their Membership.
- Reflections Holidays will use reasonable endeavours to notify Members of any material changes to these Terms or the Privacy Policy. Such notification may be provided by email, through Reflections Holidays website, or by other reasonable means.
- In addition to these Terms, all Guests and Members must review and comply with the applicable booking terms and conditions relating to their stay at a Reflections Holidays Place. The Loyalty Program does not replace or override those booking terms, which continue to apply in full.
- Limitation of liability
- These Terms govern Membership and set out the rights and obligations of Members and Reflections Holidays in relation to Reflections Holidays Outsiders Loyalty Club. They do not concern, regulate, or otherwise affect any Member’s or Guest’s separate visit to, occupation of, or use of a Reflections Holidays Place or its facilities, which are subject to their own terms and conditions.
- To the extent permitted by law, neither Reflections Holidays nor any of its officers, employees, contractors, or agents accept liability in contract, tort (including negligence), equity, under statute, or otherwise for any claim, loss, damage, cost, or expense (including consequential, incidental, indirect, or special loss or damage), including but not limited to loss arising from delay, disappointment, Membership system error, failure or malfunction, suspension or termination of Membership, or additional cost or expense, that may arise in connection with these Terms or Membership.
- Reflections Holidays will not be liable for any failure, delay, error, or interruption in performing its obligations under these Terms, or for any unavailability, inoperability, or downtime of Reflections Holidays Outsiders Loyalty Club, to the extent caused by a Force Majeure Event (as defined in Clause 1.1).
- Nothing in these Terms is intended to exclude, restrict, or limit any rights or remedies that a Member may have under the Australian Consumer Law, whether applied as a law of the Commonwealth of Australia or the State of New South Wales.
- Program Administration
- Reflections Holidays is responsible for the administration of the Program, including the allocation and redemption of Loyalty Guest Credit, the maintenance of Membership Accounts, and the publication of Benefits and Program rules.
- Reflections Holidays may, from time to time, vary the structure, operation, or rules of the Program. Where a change materially reduces the value of Loyalty Guest Credit or Benefits already accrued, Reflections Holidays will provide Members with no less than thirty (30) days’ prior notice, either by email or by publication on the Program website. If you do not agree to a material change, you may cancel your Membership at any time without penalty. Minor changes, clarifications, or improvements that do not materially disadvantage Members may be made without prior notice.
- Reflections Holidays may suspend or terminate the Program in its entirety by giving Members at least sixty (60) days’ prior notice. In such circumstances, Members will be permitted to use any Loyalty Guest Credit and Benefits accrued during the notice period, after which all unused Loyalty Guest Credit and Benefits will expire. However, any Benefits or Loyalty Guest Credit already redeemed for confirmed bookings prior to termination will be honoured in full, subject to the original booking terms and conditions.
- Termination and Suspension of Membership
- You may cancel your Membership at any time by providing notice in writing to Reflections Holidays at PO Box 212, Carrington NSW 2294 (Attention: Manager, Reflections Loyalty Club) or by sending an email to Loyalty@reflectionsholidays.com.au. This includes the right to cancel your Membership without penalty if you do not agree to any amendment of these Terms notified to you under Clause 18.1.
- Reflections Holidays may suspend or terminate your Membership:
- immediately and without prior notice if you engage in fraud, dishonesty, the resale of Benefits, or other serious misconduct that materially harms Reflections Holidays, the Program, or other Members; or
- by giving you at least 14 days’ written notice if you breach these Terms in another way, and you do not remedy the breach within that period.
- Upon cancellation, suspension, or termination of Membership:
- your Membership Account will be closed;
- any unredeemed Benefits may be forfeited, except Benefits already redeemed for confirmed bookings will continue to be honoured in full, subject to the original booking terms and conditions; and
- Reflections Holidays may withhold accrued Benefits where termination results from fraud, dishonesty, or other serious misconduct.
- Membership is personal to the Member and is not transferable, assignable, or capable of being shared with or used by another individual.
- A Member may only utilise one Membership per booking. Where more than one Membership is presented in relation to the same booking, Reflections Holidays reserves the right to determine which Membership will be recognised for the accrual or redemption of Benefits.
- Privacy and Data Protection
- Reflections Holidays collects, stores, uses and discloses your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By enrolling in the Program, you consent to Reflections Holidays collecting and using your personal information for the purposes of administering the Program, providing you with Benefits, verifying your identity, and communicating with you regarding Program matters.
- Reflections Holidays may also use your personal information for marketing purposes, including sending you promotional offers, newsletters, and information about products and services that may be of interest to you. You may opt out of receiving marketing communications at any time by following the unsubscribe instructions provided in such communications or by contacting Reflections Holidays directly.
- Reflections Holidays may disclose your personal information to third-party service providers engaged to assist with the administration of the Program, including IT service providers, data processors, marketing agencies, and affiliated Reflections. Some of these recipients may be located overseas. Reflections Holidays will take reasonable steps to ensure that any such third parties comply with the Privacy Act.
- You have the right to access and correct your personal information held by Reflections Holidays and to make a complaint if you believe your privacy has been interfered with. Full details are contained in Reflections Holidays' Privacy Policy, which is available on the website and forms part of this Agreement.
- Liability and Risk
- To the fullest extent permitted by law, Reflections Holidays excludes all warranties, guarantees, conditions and representations, whether express or implied, in relation to the Program and the Benefits. Reflections Holidays shall not be liable for any loss, damage, cost, expense or claim suffered or incurred by any Member, whether direct, indirect, consequential or otherwise, arising out of or in connection with participation in the Program, the earning, redemption, receipt or use of Benefits.
- Nothing in this Agreement operates to exclude, restrict, or modify any rights, remedies, or guarantees that cannot be excluded under the ACL. Where the ACL applies, and liability cannot lawfully be excluded, Reflections Holidays' liability shall be limited, at its option, to supplying the relevant services again or paying the cost of having those services supplied again.
- Force Majeure
- Reflections Holidays shall not be liable for any delay or failure to perform its obligations under this Agreement to the extent that such delay or failure is caused by a Force Majeure Event. Where a Force Majeure Event prevents Reflections Holidays from providing Benefits or administering the Program, it may suspend or modify the Program until such time as the Force Majeure Event has ceased.
- Intellectual Property
- All intellectual property rights in the Program, including without limitation its name, branding, logos, content, designs, and promotional materials, are owned or licensed by the NSW Crown Holiday Parks Land Manager. Participation in the Program does not confer upon Members any rights of ownership or use of such intellectual property, other than for the limited purpose of participating in the Program. Any unauthorised use is strictly prohibited.
- Assignment
- Reflections Holidays may assign, transfer or novate its rights and obligations under this Agreement to another entity without the consent of Members. Notice of such assignment will be provided by publication on the Program website. Members may not assign or transfer their Membership, or Benefits to any other person or entity.
- Dispute Resolution
- If a dispute arises out of or in connection with the Program or these Terms, including any complaint by a Member, the Member must first lodge the complaint in writing with the Reflections Holidays Loyalty Team by email to loyalty@reflectionsholidays.com.au (or such other address as Reflections Holidays may notify from time to time), providing reasonable details of the matter. A complaint may also be lodged by post to PO Box 212, Carrington NSW 2294 (Attention: Manager, Reflections Loyalty Club).
- Reflections Holidays will acknowledge receipt of the complaint within five (5) business days and will use reasonable endeavours to provide a substantive written response within fourteen (14) business days.
- If the dispute is not resolved within thirty (30) days of lodgement, either party may refer the matter to mediation conducted under the rules of the Resolution Institute of Australia. The mediator’s fees and costs shall be shared equally between the parties, and each party will bear its own legal and other costs of the mediation, unless otherwise agreed.
- If the dispute is not resolved within sixty (60) days of referral to mediation, either party may commence legal proceedings in the courts specified in clause 16.
- Nothing in this clause prevents a party from seeking urgent interlocutory relief from a court of competent jurisdiction.
- Governing Law and Jurisdiction
- This Agreement is governed by the laws of the State or Territory in which Reflections Holidays is based. By participating in the Program, you irrevocably submit to the exclusive jurisdiction of the courts of that State or Territory, and of the Commonwealth of Australia.
- Notices
- Any notice required to be given under this Agreement may be given by Reflections Holidays or a Member:
- by email to the email address recorded in the Member’s account or to Loyalty@reflectionsholidays.com.au (as applicable);
- by posting on the Program website (for notices of general application to Members); or
- by ordinary post to the postal address recorded in the Member’s account or the address of Reflections Holidays set out in these Terms.
- A notice is deemed received:
- if sent by email, when successfully transmitted to the recipient’s server (unless a delivery failure notification is received);
- if posted on the Program website, three (3) days after the date of posting; and
- if sent by ordinary post within Australia, five (5) business days after posting.
- General
- Amendments
- Reflections Holidays may amend, vary, or replace these Terms, the Program structure, or any Benefits (including, without limitation, Loyalty Guest Credit, Tier Status criteria, or any other reward mechanism) from time to time. Any such amendment will take effect from the date specified in the notice provided to Members, which may be given by email, post, or by publication on the Reflections Holidays website. Reflections Holidays will not make amendments that materially reduce the value of Benefits or rights already accrued without providing Members with at least thirty (30) days’ prior notice. If you do not agree to the amended Terms, you may cancel your Membership at any time without penalty. Continued use of Membership following the effective date of an amendment constitutes acceptance of the amended Terms.
- Waiver
- No waiver of any breach of these Terms shall be deemed a waiver of any subsequent breach. No delay or omission by Reflections Holidays in exercising any right, power, or remedy shall operate as a waiver thereof, and a waiver will only be effective if made in writing and signed by an authorised officer of Reflections Holidays.
- Severability
- If any provision of these Terms is found to be invalid, unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be severed to the extent necessary, and the validity and enforceability of the remaining provisions shall not be affected. The parties agree to negotiate in good faith a valid replacement provision that most closely reflects the intended purpose of the invalid provision.
- Survival
- All provisions of these Terms which by their nature are intended to survive termination or expiry of Membership shall continue in full force and effect. This includes, without limitation, provisions relating to limitation of liability, indemnity, privacy, intellectual property, accrued rights, and any obligation to pay monies owing.
- Force Majeure
- Reflections Holidays shall not be liable for any failure, delay, or interruption in performing its obligations under these Terms where such failure, delay, or interruption is due to a Force Majeure Event (as defined in Clause 1.1). Where a Force Majeure Event prevents or delays performance for a period exceeding sixty (60) consecutive days, Reflections Holidays may, at its discretion, suspend or terminate the Program or any affected Membership without liability.
- Entire Agreement
- This Agreement constitutes the entire agreement between Reflections Holidays and the Member in relation to the Program and supersedes all prior understandings, representations, or agreements. If any provision of this Agreement is found to be invalid or unenforceable, the remainder of the Agreement shall continue in full force and effect.
